The AEAFA Central Conference coincides this year with the thirtieth anniversary of this association, founded in 1993 , 12 years after the enactment of the Spanish Divorce Law, by a group of pioneer lawyers in Family Law in Spain.



Since its founding, the AEAFA has defended the creation of specialization in matters of Childhood, Family and Capacity within the Civil jurisdictional order. “All families have the right to have specialized Family Courts, in the same way that companies already enjoy specialized Commercial Courts. Currently, 53% of Spaniards do not have access to these specialized courts, which are concentrated only in the country's large cities,” says the president of the AEAFA, María Dolores Lozano .

Among the speakers, the interventions of the judges of the Civil Chamber of the Supreme Court Ángeles Parra Lucán and José Luis Seoane Spiegelberg stand out. The first will address economic aspects of family breakups, while Seoane will focus on the binding nature of marriage agreements when child custody is discussed.

Is it easy to investigate possible paternity?
For his part, the Córdoba magistrate Antonio Javier Pérez Martín will focus on the problem related to affiliation. “There is a belief that our right is governed by the principle of “free investigation of paternity”, but let no one be fooled, because that is not true , since the legislator himself places enormous obstacles so that it can be investigated freely. paternity,” says Pérez Martín.

The professor of Civil Law Matilde Cuena will focus her intervention on the new bankruptcy law and its implications in divorce processes. “When the debtor is married in community property, the bankruptcy process is significantly altered and complicated, to such an extent that the ex-partner can be involved with very adverse effects,” Cuena warns.

For their part, Civil Law professors Carmen López-Rendo and Clara Gago will review actions in defense of hereditary rights, that is, what can be done when the legitimate inheritance is deprived of you.

Finally, Judge Francisco Javier Forcada will resolve doubts about the new European regulation regarding jurisdiction, the recognition and execution of resolutions in matrimonial matters and parental responsibility, and about international child abduction.

In Spain, nearly 500 child abductions are recorded each year by the father or mother, who takes the child from the place of habitual residence without the consent of the other parent.

Children avoid breakups
The Observatory report also reveals that the other reasons given by clients for stopping breakups are the belief that the marital crisis will cause serious harm to the children (19% of cases), followed by a conformist position with the situation of partner (16%) and the fear of losing social status (13%).
